The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company's terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client's needs in respect of provision of the Company's stated services, in accordance with and subject to, the law. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website. Nothing in this disclaimer will:

As long as the website and the information and services on the website are provided free of charge, we will not be liable for any loss or damage of any nature.

THE PARTIES. This Short-Term Rental Agreement (“Agreement”) made on {{reservation_date}} between the following:

Guest: {{guest_name}} (“Guest”), and

Host: {{host_name}} (“Host”).

THE PREMISES. The Host agrees to lease the described property below to the Guest, and the Guest agrees to rent from the Host:

Hereinafter known as the “Premises.”

LEASE TERM. The Guest shall be allowed to occupy the Premises starting {{checkin_date}} from {{checkin_time}} and ending {{checkout_date}} at {{checkout_time}} (“Lease Term”).

QUIET HOURS. Quiet hours begin at 10:00 PM each night and continue until sunrise. Quiet hours consist of no music and keeping all audio at a minimum level out of respect for the surrounding residents.

OCCUPANTS. Guests under the age of 18 unaccompanied by a parent or legal guardian will not be permitted to register and will lose all funds paid to Agent. Any reservations made under false pretences will result in loss of advance payments and possible removal of guest from rental unit. The total number of individuals staying on the Premises during the Lease Term shall be a total of {{number_of_guests}} guests. If more than the authorized number of guests listed above are found on the Premises, this Agreement will be subject to termination by the Host.

BOOKING FEES. The Guest shall pay the Host the amount as detailed during the booking process.

CANCELLATION POLICY:

Cancellations prior to 30 days before arrival are full refundable (except Group Reservations) Group deposit is forfeited at 90 days)

Cancellations with less than 30 days' notice but before 7 days of check-in will only receive 50% refund of their reservation.

Cancellations, shortened days or No shows with less than 7 days of check-in are NOT refundable

Any unit changes made within 30 days of arrival will incur at a minimum a charge of $50 per night.

UTILITIES. The Host shall be responsible for all utilities and services to the Premises EXCEPT for the following: None.

SECURITY DEPOSIT

Security Deposit amount as detailed in the booking process. The Security Deposit is for the faithful performance of the Guest under the terms and conditions of this Agreement. The Guest must pay the Security Deposit at the execution of this Agreement. The Security Deposit shall be returned to the Guest within the State's requirements after the end of the Lease Term less any itemized deductions. This Security Deposit shall not be credited towards any Rent unless the Host gives their written consent.

CREDIT CARD ON FILE: In order to ensure that any and all damages in excess of normal use are covered, we require a Valid Credit Card on file at the time of Check In. We will try to contact you prior to charging your Card for excessive damage above and beyond normal wear and tear.

REFUND POLICY: Agent(s) cannot guarantee against mechanical failure of heating, air conditioning, Hot Tubs, TVs, or other appliances. Please report any inoperative equipment to our office immediately. Agent will make every reasonable effort to have repairs done quickly and efficiently. No refunds or rent reductions will be made due to failure of appliances or equipment. No refunds for early departures (less days than reserved) ~ No refunds will be given for delayed arrival ~ No refunds for reducing the number of nights reserved ~

PETS. Pets: ONLY IN DESIGNATED UNITS.

Reservation must be made for your pet. Pet fees are $25.00 per pet (one time charge for the entire length of your stay) with a 2-dog limit. Unfortunately, we cannot accept all breeds of dogs please see dog breed restrictions below.

PET POLICY:

The purpose of this policy is to insure the best possible environment for all of our guests, both pet owners and non-pet owners and to insure the responsible

care of all pets.

1. Pets shall be restrained (pets must be leashed) when on the park property.

2. All guests who wish to bring a pet must have a unit that is specific for pets.

3. No pets are allowed on any resort furniture.

4. Allowed common household pets such as dogs and cats are allowed except for the restricted dog breeds listed above.

5. Each Pet owner is limited to having 2 pets on site

6. Pets are not allowed to be a nuisance to others at any time.

7. Pet owners must be able to maintain control over their pets at all times.

8. Pets are not allowed to be left unattended in Units or Vehicles or tied up outside unattended.

9. Pets are not allowed to disrupt the park with excessive noise (barking, whining, crying).

10. Pets are not allowed in any resort buildings, the pool/spa area or on the athletic courts.

11. Pet owners are responsible for cleaning up after their pet. Dog Stations are available around the park.

12. Management reserves the right to require any misbehaved pets to leave the resort.

Any violations to the above rules will be fined $25 PER INCIDENT.

KITCHENS: If you are in a Unit that has a kitchen, please throw away all food, clean kitchen and put dirty dishes in dishwasher and start the dishwasher (cleaning pods are provided in the drawer). Also, there is a lock on the lid of the garbage cans in the kitchens, we would appreciate it if you would lock the lid to keep the trash from blowing out. There will be a minimum $35 fee for non-compliance.

BBQ: BBQ grill brushes are provided for each unit. Guests are required to clean off their BBQ grill, tools, and grilling area after use. There will be a $50 fee for non-compliance.

ROOMS: Please leave the wet towels in shower and lock the door when you leave (see instructions below).

SMOKING POLICY. Smoking on the Premises is prohibited.

HOT TUBS: Are for designated units only and not for public use. Hot tubs have been cleaned prior to your arrival. There will be a $15.00 charge if guests(s) require an additional cleaning of the hot tub during Guest(s) stay. For Guest(s) safety and health, each hot tub is cleaned, disinfected, chemically treated, and tested following each stay. There is NO LIFEGUARD ON DUTY. Children under 14 years of age must be under the direct supervision of an adult while in the hot tub area. Children 5 and under are not allowed in the hot tub (average temperature in the spa is 104 degrees). All guests must shower before entering the hot tub. Please, no lotions or oils in the hot tub. No glass whatsoever is allowed in the hot tub area, food and smoking is also not permitted in this area. Appropriate swimwear is required. Please make sure to cover the hot tub with the designated cover when not in use and secure the straps. All users must abide by the posted rules.

LINENS: A basic supply of linen is provided in each property. Bed linen and bath towels are not changed during your stay. You can request clean linens by contacting our resort office.

FURNISHINGS: Furnishings are subject to change without notice. Furniture, bedding, mattress pads, utensils or any other property supplied with the rental property must not be taken out or transferred from one property to another. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to the guest(s).

PEST CONTROL: Many different pests live and thrive in this region. Your unit has been professionally treated by a commercial pest control company with precise and

complete preventative treatments in an effort to keep all the pests and bugs outside. Should you experience a pest control issue, please contact Agent so we may attempt to eradicate the problem. Please know, that late Spring and early Summer is Gnat season. We are an outdoor Glamping Resort and the bugs will be present at the park.

LISTING & PRICING: Information regarding individual listings is believed accurate but cannot be guaranteed. We have made every effort to ensure that all the information on Agent’s website(s) is current and accurate. Rates, furnishings, fees, and taxes are subject to change without notice.

SUBLETTING. The guest does not have the right to sublet the Premises.

INSPECTION. The Host has the right to inspect the Premises with prior notice as in accordance with State law. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately in accordance with State law. The Guest waives all rights to process if they fail to vacate the premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this agreement.

MAINTENANCE AND REPAIRS. The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner. The Guest shall leave the Premises in a ready to rent condition at the expiration of this Agreement, defined by the Host as being immediately habitable by the next Guest. The Guest shall pay for maintenance and repairs should the Premises be left in a lesser condition. The Guest agrees that the Host shall deduct costs of said services from any Security Deposit prior to a refund if Guest causes damage to the Premises or its furnishings.

TRASH. The Guests shall dispose of all waste material generated during the Lease Term under the strict instruction and direction of the Host.

QUIET ENJOYMENT. The Guest, along with neighbours, shall enjoy each other’s company in a quiet and respectful manner to each other’s enjoyment. The Guest is expected to behave in a civilized manner and shall be good neighbours with any residents of the immediate area. Creating a disturbance of the area by large gatherings or parties shall be grounds for immediate termination of this Agreement.

USE OF THE RESORT: The resort includes bison (aka American Bison) in an enclosed pasture. These animals are on the property only for guests to observe. Guests must remain more than 6 feet away from fencing for the bison pasture. Guests shall not feed, harass, annoy, excite or otherwise disturb the bison or attempt to do so. Parents and legal guardians shall monitor and supervise their children at the Resort, especially when in proximity to the bison.

HOST’S LIABILITY. The Guest and any of their guests hereby indemnify and hold harmless the Host against any and all claims of personal injury or property damage or loss arising from the use of the Premises regardless of the nature of the accident, injury or loss. The Guest expressly recognizes that any insurance for property damage or loss which the Host may maintain on the property does not cover the personal property of Guest and that Guest should purchase their own insurance for their guests if such coverage is desired.

ATTORNEY’S FEES. The Guest agrees to pay all reasonable costs, attorney's fees, and expenses that shall be made or incurred by the Host enforcing this agreement.

USE OF PREMISES. The Guest shall use the Premises for residential use only. The Guest is not authorized to sell products or services on the Premises or conduct any commercial activity.

ILLEGAL ACTIVITY. The Guest shall use the Premises for legal purposes only. Any other such use that includes but is not limited to illicit drug use, verbal or physical abuse of any person or illegal sexual behaviour shall cause immediate termination of this Agreement with no refund of pre-paid Rent.

POSSESSIONS. Any personal items or possessions that are left on the Premises are not the responsibility of the Host. The Host shall make every reasonable effort to return the item to the Guest. If claims are not made within the State’s required time period or two (2) weeks, whichever is shorter, the Host shall be able to keep such items to sell or for personal use.

GOVERNING LAW. This Agreement shall be governed and subject to the laws located in the jurisdiction of Premise’s location.
